Privacy Policy

Effective date: October 7, 2026 Last updated: October 7, 2026

Fundamental Fungi LLC ("Fundamental Fungi," "we," "us" or "our"), respects your privacy. This Privacy Policy explains what personal information we collect when you visit fundamentalfungi.com (the "Site"), buy from us or contact us (together, the "Services"); how we use and share it; and the choices and rights you have.

1. Who May Use the Services

The Services are intended for adults 18 and older. We do not knowingly collect personal information from anyone under 18. If you believe a minor has given us personal information, contact us and we will delete it.

2. Information We Collect

Information you give us:

• Contact details, such as your name, email address, phone number, and shipping and billing address.
• Order information, such as products purchased, order history, and payment confirmation. Card details are entered at checkout and processed by Shopify Payments and our other payment providers; we do not store full card numbers.
• Account information, such as your login email and password.
• Communications, such as emails, reviews, survey responses and messages to customer support.
• Marketing sign-ups, such as the email address you give us for news and offers.

Information collected automatically:

When you use the Site, we and our service providers collect information such as your IP address (which may show your general location), device and browser type, pages viewed, products viewed or added to cart, referring website, and the date and time of your visit. We collect this using cookies, pixels and similar technologies (see Section 6).

Information from others:

We may receive information from Shopify, payment providers, shipping carriers, and analytics or advertising partners.

3. How We Use Your Information

• To process and ship your orders, handle returns and refunds, and send order and shipping updates.
• To provide customer support and respond to your requests.
• To create and manage your account.
• To send marketing emails if you've signed up. You can unsubscribe at any time using the link in any email.
• To understand how the Site is used and improve our products and Services.
• To measure and improve our advertising.
• To detect and prevent fraud, and to protect our rights, customers and the Services.
• To comply with legal obligations.

4. How We Share Your Information

We do not sell your personal information for money. We share it only as described here:

• Service providers that help us run our business, including our e-commerce platform (Shopify), payment processors, shipping carriers and fulfillment partners, email and customer-service tools, and review platforms. They may use your information only to provide services to us.
• Analytics partners. We use Google Analytics (provided by Google LLC) to understand how visitors use the Site and how our marketing performs. These partners collect information through cookies and similar technologies (see Section 6). Under some state laws, this may count as "sharing" for targeted advertising; you can opt out as described in Section 8.
• Marketplaces and payment options you choose, such as Shop Pay, PayPal, Apple Pay, Google Pay or Amazon Pay, which handle your information under their own privacy policies.
• Legal and safety reasons, such as to comply with law, respond to lawful requests, enforce our Terms of Service, or protect the rights and safety of others.
• Business transfers, such as a merger, acquisition or sale of assets, in which case your information may transfer to the new owner under this policy.
• With your consent or at your direction.

5. Reviews and Public Content

If you post a review or other content on the Site, it may be visible to the public. Please don't include personal health information in public reviews.

6. Cookies and Similar Technologies

We and our partners use cookies, pixels and similar technologies to run the Site (for example, to keep items in your cart), to remember your preferences, to understand how the Site is used, and to measure our advertising. For details on the cookies Shopify uses, see shopify.com/legal/cookies.

You can control cookies through our cookie banner (where shown) and your browser settings. Blocking some cookies may stop parts of the Site from working.

We honor Global Privacy Control (GPC) signals as a request to opt out of the sale or sharing of personal information and targeted advertising for that browser. Because there is no common standard for other "Do Not Track" signals, we do not respond to them.

7. How Long We Keep Information

We keep personal information for as long as needed to provide the Services, maintain business and tax records, resolve disputes and enforce our agreements, and then delete or de-identify it.

8. Your Privacy Rights

Depending on where you live (for example, California, Colorado, Connecticut, Virginia, Texas, Oregon and other states with consumer privacy laws), you may have the right to:

• Know and access the personal information we hold about you.
• Correct inaccurate information.
• Delete your personal information.
• Get a copy of your information in a portable format.
• Opt out of the sale or sharing of personal information and of targeted advertising.
• Appeal our decision if we deny your request.

To make a request, email support@fundamentalfungi.com with the subject line "Privacy Request" or call (954) 232-7899. To opt out of sale, sharing or targeted advertising, use the "Your Privacy Choices" link at the bottom of the Site, turn on Global Privacy Control in your browser, or email us. We will verify your identity before responding, usually by matching your email and order details. You may use an authorized agent; we'll ask for proof that you authorized them. To appeal a decision, reply to our response with "Appeal" in the subject line. We will not discriminate against you for exercising your rights.

California residents: in the past 12 months we have collected identifiers, commercial information (order history), and internet activity, for the purposes and from the sources described above. We disclose these categories to the recipients listed in Section 4. We do not use or disclose sensitive personal information to infer characteristics about you.

9. Marketing Emails

You can unsubscribe from marketing emails at any time using the link in any email or by contacting us. We'll still send transactional messages about your orders.

10. Security

We use reasonable safeguards to protect your information, and payments are processed over encrypted connections. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

11. Third-Party Sites

The Site may link to sites we don't control, such as social media pages. Their privacy practices are governed by their own policies.

12. International Visitors

We are based in the United States and sell to U.S. addresses. If you access the Site from outside the U.S., your information will be processed in the United States.

13. Changes to This Policy

We may update this policy from time to time. We'll post the new version here and change the "Last updated" date. Significant changes will be highlighted on the Site or sent by email.

14. SMS/Text Messaging

If you opt in to receive text messages from Fundamental Fungi, we collect your mobile phone number and your consent record to send you recurring automated marketing and cart reminder texts. Consent is not a condition of purchase.

We do not sell, rent or share your mobile phone number or SMS opt-in data and consent with third parties or affiliates for their marketing or promotional purposes. Your information may be shared only with service providers that help us deliver messages (such as our SMS platform), solely to provide the service.

You can opt out at any time by replying STOP to any message. Reply HELP for help, or contact us at support@fundamentalfungi.com or (954) 232-7899.
