These Terms of Service ("Terms") govern your use of fundamentalfungi.com (the "Site") and any purchase you make from Fundamental Fungi LLC ("Fundamental Fungi," "we," "us" or "our"). By using the Site or placing an order, you agree to these Terms, our Privacy Policy, Refund Policy and Shipping Policy, which are part of these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old to use the Site and buy our products. By placing an order, you confirm that you are 18 or older and that the information you provide is accurate.
2. Our Products Are Dietary Supplements
Fundamental Fungi products are dietary supplements made with functional mushroom extracts such as Lion's Mane and Cordyceps. They are non-psychoactive and do not contain psilocybin.
Statements on the Site and our packaging have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure or prevent any disease.
Information on the Site, including blog articles, is for general educational purposes and is not medical advice. Talk with your doctor before using any supplement, especially if you are pregnant or nursing, take medication, have a medical condition, or have a mushroom or food allergy. Stop use and consult a doctor if you have an adverse reaction. Do not exceed the suggested use on the label. Keep out of reach of children. Individual results vary.
3. Orders, Pricing and Payment
All prices are in U.S. dollars. Prices and availability can change without notice. Your order is an offer to buy; it is accepted when we ship it. We may refuse, limit or cancel any order, including orders that appear to be for resale or that involve suspected fraud, and orders affected by a pricing or product error. If we cancel after you've been charged, we'll refund you in full.
You agree to provide current, complete and accurate purchase and account information. Payments are processed by Shopify Payments and other payment providers shown at checkout. Applicable sales tax is added at checkout.
Subscribe & Save (Automatic Renewal)
Some products can be purchased as a Subscribe & Save subscription, which renews automatically. By choosing Subscribe & Save, you authorize us to charge your payment method on file the subscription price shown at checkout, plus applicable sales tax, when you sign up and again at the delivery frequency you select, until you cancel. Shipping is free. The subscription price is the regular price minus the Subscribe & Save discount shown on the product page and at checkout. If we change the subscription price, discount or terms, we will email you before the change applies, and you can cancel before it takes effect.
Cancel anytime. There is no minimum number of orders and no cancellation fee. Cancel online by logging into your account at fundamentalfungi.com/account, or email support@fundamentalfungi.com or call (954) 232-7899. Cancel before your next billing date to avoid the next charge. Where available, you can also skip, pause or change your deliveries from your account. After you subscribe, we’ll email you a confirmation with these terms and how to cancel. If a renewal payment fails, we may retry it and contact you; if it can’t be collected, we may pause or cancel your subscription. Subscription orders are covered by our Refund Policy.
4. Shipping, Returns and Refunds
Shipping is governed by our Shipping Policy (fundamentalfungi.com/policies/shipping-policy). Returns and refunds are governed by our Refund Policy (fundamentalfungi.com/policies/refund-policy). Title and risk of loss pass to you when we hand your order to the carrier, but we will still help with lost or damaged packages as described in our Shipping Policy.
5. Authorized Sellers
We can only stand behind products bought from fundamentalfungi.com. Products bought from unauthorized resellers or third-party marketplace sellers may be counterfeit, expired or improperly stored, and are not covered by our Refund Policy or satisfaction guarantee.
6. Accounts
You are responsible for keeping your account login confidential and for activity on your account. Tell us right away if you believe your account has been used without permission.
7. Product Information
We try to describe our products and show their images accurately, but colors may vary by screen, and typographical errors can occur. The product label is the final source for ingredients, serving size and directions. We may correct errors and update information at any time.
8. Reviews and Submissions
If you post a review, comment or other content, you confirm that it is honest, based on your own experience, and doesn't violate anyone's rights or include unlawful material. You grant us a non-exclusive, royalty-free, perpetual license to use, reproduce and display that content in connection with our business. We may remove content at our discretion. If you send us ideas or suggestions, we may use them without obligation to you.
9. Prohibited Uses
You may not use the Site to break any law; buy products for unauthorized resale; submit false information; infringe anyone's intellectual property; upload viruses or malicious code; scrape, crawl or collect data from the Site without permission; or interfere with the Site's security or operation.
10. Intellectual Property
The Fundamental Fungi name, logo, product designs, photos, text and other Site content belong to us or our licensors and are protected by law. You may not copy or use them without our written permission.
11. Third-Party Links and Tools
The Site may link to or include tools from third parties, such as payment and review providers. We don't control and aren't responsible for their content, products or practices.
12. Disclaimer of Warranties
Except as expressly stated in these Terms or required by law, the Site and our products are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site will be uninterrupted or error-free, or that any product will produce a particular result for you.
13. Limitation of Liability
To the fullest extent permitted by law, Fundamental Fungi and its owners, employees, affiliates and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or lost profits, arising from your use of the Site or our products. Our total liability for any claim related to a product or order will not exceed the amount you paid for that order. Some states don't allow these limits, so they may not apply to you.
14. Indemnification
You agree to defend and hold harmless Fundamental Fungi and its owners, employees and affiliates from any claims, losses and reasonable attorneys' fees arising from your breach of these Terms or your misuse of the Site or our products.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Before filing any claim, please contact us at support@fundamentalfungi.com so we can try to resolve it informally within 30 days. Any lawsuit that isn't resolved informally must be brought in the state or federal courts located in Broward County, Florida, and you and we consent to their jurisdiction. Either party may bring a qualifying claim in small claims court instead.
16. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date shows when they last changed. Changes apply to orders placed after they are posted.
17. General
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the policies they reference, are the entire agreement between you and us about the Site and your purchases. Our store is hosted by Shopify Inc.
18. SMS/Text Messaging Terms
By providing your mobile number and opting in, you agree to receive recurring automated marketing text messages (such as offers, product updates and cart reminders) from Fundamental Fungi at the number provided, including messages sent from (888) 311-2819. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply.
